Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Marian Vinicay, a sole trader based in New York, United States ("we", "us", "our"), covering your use of the MacMusicKeys website, the MacMusicKeys application (the "App"), and related services (together, the "Service"). By downloading, installing, or using the App, or by subscribing, you agree to these Terms. If you do not agree, do not use the Service.

1. What MacMusicKeys does

MacMusicKeys is a macOS menu-bar utility that routes your hardware media keys (Play/Pause, Next, Previous) to Apple's Music app. It requires macOS 13 or later and the macOS Accessibility permission to function; the Automation permission is needed for it to control Music.

2. License to use the App

Subject to these Terms and to an active subscription or trial, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Mac computers that you own or control, for your own use. A single license may be active on up to five (5) devices at a time; activating a sixth device signs out the one used least recently.

You may not:

• copy, sell, rent, sublicense, or redistribute the App or your license key;
• reverse-engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law;
• remove or alter any proprietary notices; or
• use the App in any way that breaks the law or infringes others' rights.

We retain all rights, title, and interest in the App, the website, and all related intellectual property. These Terms grant you a license, not a sale.

3. Free trial

Each local macOS account is eligible for one 7-day free trial. After Accessibility and Automation permissions are granted, the trial period begins only when you click Start 7-day trial in the App. Granting permissions alone does not start the trial. No payment details are required, no payment is taken during the trial, and starting the trial does not create a subscription. An internet connection is required once to issue the trial; the trial then works offline. Reinstalling the App or deleting its local data does not create another trial for the same account when the App can derive its account-scoped trial identifier. A new owner using a newly created local account may receive a fresh trial. When the trial ends, the App stops working until you subscribe.

4. Subscription, billing, and the Merchant of Record

After the trial, MacMusicKeys costs $3.65 per year. Unless you cancel, the subscription automatically renews once a year at the then-current price, and the renewal is charged through Paddle using your saved payment method. Prices may change; we will give reasonable notice of any change before it applies to a renewal.

5. Cancellation and refunds

Because MacMusicKeys includes a 7-day free trial that you start explicitly, you can evaluate it fully before making a purchase.

You can cancel at any time. Use the management link in your Paddle purchase receipt (see our cancellation page for the steps), or email [email protected]. Cancellation takes effect at the end of your current billing period - your subscription stays active until then, does not renew, and you are not charged again.

All purchases are subject to Paddle's Refund Policy. Where the law in your country gives you a statutory right to withdraw from your purchase within a set period, that right is administered by Paddle.

In addition to any statutory rights, we offer a 14-day money-back guarantee on your first subscription payment. To request a refund, email [email protected], or use our refund form within 14 days of your initial purchase. Renewal payments are not refundable, but you can cancel at any time (see above) to prevent future charges.

Refunds may be refused in cases of suspected fraud or refund abuse. Nothing in this policy limits your rights under applicable consumer-protection law.

6. Your consumer rights

Nothing in these Terms limits or excludes any rights you have under the mandatory consumer-protection laws of your country of residence that cannot legally be limited or excluded. For example, if you are a consumer in the EU or UK, you keep any statutory right to withdraw from or cancel your purchase; those rights are handled through Paddle as Merchant of Record. Where such laws conflict with these Terms, those laws prevail.

7. When access ends

The App stops working if your subscription lapses (for example, if a renewal payment fails, or if you cancel and the paid period ends) or if a payment is refunded or charged back. You can restore access at any time by subscribing again. We may suspend or end your access if you materially breach these Terms.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or compatible with every macOS version or configuration.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us (through Paddle) in the 12 months before the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Material changes will take effect for renewals or continued use after the update. Your continued use of the Service after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules, and you and we submit to the courts located in New York for any dispute - except where the mandatory law of your country of residence gives you the right to bring proceedings elsewhere.
